By accessing or using SimiaNet QR ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. The Service is operated by an individual sole proprietor ("we," "us," or "our").

2. Description of Service

SimiaNet QR is a web-based QR code generation and analytics platform. We offer:

  • Free Tier: Basic QR code generation for URLs, text, WiFi networks, and contact cards (vCard), with PNG download capability.
  • Pro Tier: Advanced features including custom colors, logo embedding, multiple export formats (SVG, PDF), bulk generation, and scan analytics with trackable QR codes.

3. User Accounts

The Service uses email-based identification for Pro features and trackable QR codes. You are responsible for maintaining the confidentiality of your license key and any account credentials. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use Policy

You agree not to use the Service to:

  • Generate QR codes that link to malware, viruses, or other malicious software
  • Create QR codes for phishing, scams, or fraudulent purposes
  • Distribute illegal content or facilitate illegal activities
  • Send unsolicited bulk communications (spam)
  • Infringe on intellectual property rights of others
  • Harass, abuse, or harm other individuals
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or servers

We reserve the right to terminate accounts and remove QR codes that violate these terms without notice.

5. Intellectual Property

Your Content: You retain ownership of any content you encode in QR codes. You grant us a limited license to process and store this content solely for providing the Service.

Our Platform: The SimiaNet QR platform, including its design, features, and code, is our intellectual property. You may not copy, modify, or reverse engineer any part of the Service.

6. Payment Terms

The Pro tier is available as a subscription at $4.99 USD per month or $39.99 USD per year. Payment is processed securely through Stripe. Upon subscribing, you will receive a license key to activate Pro features. Subscriptions renew automatically and can be canceled at any time.

Cancellation Policy: You may cancel your subscription at any time. Upon cancellation, you will retain Pro access until the end of your current billing period. No partial refunds are issued for unused time within a billing cycle.

Existing Lifetime Licenses: Customers who purchased a lifetime license prior to the introduction of subscription pricing retain permanent access to Pro features under their original terms.

7. Data Collection & Privacy

We collect and process certain data to provide the Service. This includes email addresses (for Pro users), IP addresses, and analytics data for trackable QR codes. For complete details on how we handle your data, please review our Privacy Policy.

8. Third-Party Services

The Service integrates with third-party providers:

  • Google Analytics: For website usage analytics
  • Stripe: For payment processing and subscription management

These services have their own terms and privacy policies that govern their use.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

QR codes generated through the Service encode data in a standard format. We are not responsible for how third-party QR code readers interpret or handle this data.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Trackable QR codes associated with terminated accounts may be deactivated.

12. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of the United States.
